klia2 Received Certificate of Completion and Compliance Prior to Opening on 2 May 2014

Malaysia Airports explains on the CCC and CPC for klia2

SEPANG – Malaysia Airports wishes to clarify that klia2 terminal received the Certificate of Completion and Compliance (CCC) prior to its opening on 2 May 2014. It was obtained on 17 April 2014 and its issuance is restricted to technical issues concerning health, safety and essential services as required by local authorities such as Jabatan Bomba dan Penyelamat Malaysia, Majlis Perbandaran Sepang and Indah Water Konsortium Sdn Bhd.  The CCC certified that the terminal was safe and fit for occupation. The CCC is a statutory certificate issued under the Street, Drainage and Building Act 1974.

The Certificate of Practical Completion (CPC), on the other hand, is a certificate issued contractually by Malaysia Airports when it is satisfied that all works have been completed to its satisfaction, meeting all the requirements of the contract. In relation to klia2, there are material contractual obligations on the part of the contractor which have not been satisfied.

Prior to the issuance of the CPC, the contractor is under an obligation to complete all works to the satisfaction of MAHB.

Malaysia Airports has notified the contractor of its intention to impose liquidated damages (LAD) and the LAD will continue to apply in accordance with the terms of the contract.
